Terms of Service

1. Who we are
Pencilfox ("Pencilfox," "we," "us") provides a software service that generates, hosts, and delivers educational practice worksheets, lessons, and tests ("Content") to teachers, homeschool parents, and educational institutions ("you," "your account holder").
By creating an account, you agree to these Terms of Service.
2. Your license to the Content
When you generate or access Content through Pencilfox, we grant you a limited, non-exclusive, non-transferable, revocable license to use that Content for the following purposes only:
- Personal classroom instruction with students enrolled at your school or in your homeschool
- Internal professional review and lesson planning
- Printing or digital distribution to your own students, with attribution preserved
This license is granted to you personally (or to your single institution for institutional plans). It is not transferable to other teachers, schools, or organizations.
3. What you may NOT do
You agree not to, and not to permit any third party to:
- Resell, sublicense, or redistribute the Content, in whole or in part, in any form, for any compensation or consideration.
- Upload, post, or republish the Content on any third-party platform, including but not limited to Teachers Pay Teachers, Etsy, Scribd, TES, Google Drive public folders, GitHub public repositories, social media, blogs, or file-sharing services.
- Remove, alter, or obscure any attribution, watermark, license metadata, branding, or copyright notice embedded in the Content.
- Reverse-engineer the watermarking, license metadata, or fingerprinting embedded in the Content.
- Use the Content to train, fine-tune, or evaluate any artificial intelligence model, machine learning system, or automated content-generation system.
- Scrape, bulk-download, or systematically harvest Content from Pencilfox, whether through the user interface, API, or any other means.
- Share your account credentials with anyone outside your immediate household (homeschool plans) or institutional contract (institutional plans).
4. Watermarks and fingerprints
You acknowledge that all Content delivered through Pencilfox is embedded with both visible and non-visible identifiers that uniquely associate the Content with your account. These identifiers are intended to deter unauthorized redistribution and to identify the source of leaked Content. Attempting to remove, modify, or obscure these identifiers is a material breach of these Terms.
5. Liquidated damages
You acknowledge that unauthorized redistribution of Content causes harm to Pencilfox that is difficult to quantify precisely. As a reasonable estimate of that harm, you agree that:
- For each individual piece of Content redistributed, reposted, or resold in violation of these Terms, you owe Pencilfox liquidated damages of fifty dollars ($50) per Content item per platform on which it appears, in addition to any actual damages or attorneys' fees incurred in enforcement.
These damages are in addition to, not in lieu of, Pencilfox's right to seek injunctive relief, statutory copyright damages, and termination of your account.
6. Termination
We may suspend or terminate your account at any time for breach of these Terms. Upon termination:
- Your license to access future Content ends immediately.
- Your license to retain previously downloaded Content is revoked, and you agree to delete all copies in your possession or control.
- Any liquidated damages, fees, and obligations accrued before termination remain due.
7. Content ownership and accuracy
Pencilfox owns or licenses all rights in the Content delivered through the service. We do our best to ensure Content is accurate and pedagogically sound, but we provide it "as is" without warranties. You are responsible for reviewing Content before using it with students.
8. Student data
You may paste student work into Pencilfox to score and track mastery. You represent that you have the right under FERPA, COPPA, and any applicable district policy to do so. We process this data only to provide the service and never sell student data.
9. AI-generated Content
Some Content is generated using large language models. While we validate generated Content for correctness, you acknowledge that AI-generated material may contain errors. You are responsible for review.
10. Reporting violations
To report unauthorized redistribution of Pencilfox Content, email abuse@pencilfox.app with the URL or screenshot. We respond to verified DMCA takedown requests within five business days.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email at least thirty days before they take effect. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts of Texas.
